Terms of Service

These Terms of Service ("Terms") govern your access to and use of Nova Vision AI ("Service"), operated by Nova Vision AI ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Nova Vision AI. By using the Service, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent. We reserve the right to verify age and suspend accounts where eligibility requirements are not met.

2. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Use a strong, unique password for your account
• Not share your account with others
• Notify us immediately if you suspect unauthorized access
• Accept responsibility for all activity that occurs under your account

We are not liable for any loss resulting from unauthorized use of your account due to your failure to protect your credentials.

3. Acceptable Use

You agree to use Nova Vision AI only for lawful purposes and in a manner that does not infringe the rights of others. You may use the Service to:

• Generate AI images and videos for personal, commercial, or creative use (subject to third-party provider terms)
• Chat with the Nova AI assistant for information, creative writing, coding help, or general questions
• Save and manage your generation history through your account

4. Prohibited Content and Activities

You must not use Nova Vision AI to generate, store, or share:

• Sexual or explicit content of any kind
• Content depicting or sexualizing minors (CSAM) — strictly prohibited and will be reported to authorities
• Content designed to harass, threaten, or harm individuals
• Realistic deepfakes intended to deceive or defame real people
• Content promoting terrorism, extremism, or political violence
• Content that violates any applicable law or regulation
• Spam, malware, phishing content, or social engineering material
• Medical, legal, or financial advice intended as a substitute for professional consultation

You also must not:

• Attempt to circumvent rate limits, authentication, or access controls
• Reverse-engineer, scrape, or extract the Service's underlying models or data
• Use automated bots or scripts to abuse the Service
• Resell access to the Service without authorization

5. AI-Generated Output Disclaimer

Nova Vision AI generates content using third-party AI models (including OpenAI and xAI). You acknowledge that:

• AI-generated content may contain inaccuracies, errors, or biased outputs
• We do not verify or guarantee the accuracy, completeness, or fitness of AI outputs
• AI outputs should not be relied upon for medical, legal, financial, or safety-critical decisions
• Generated images may coincidentally resemble real people, places, or copyrighted works — you are responsible for reviewing outputs before use

By using the Service you accept full responsibility for how you use AI-generated content.

6. Intellectual Property

Your prompts: You retain ownership of the prompts you submit.

Generated outputs: Subject to applicable third-party AI provider terms, you generally own the right to use images and text generated from your prompts for personal and commercial purposes. We recommend reviewing OpenAI's usage policy and xAI's usage policy for the precise terms applicable to AI-generated content.

Nova Vision AI platform: All website design, code, branding, and non-AI-generated content is owned by Nova Vision AI and may not be copied or reproduced without permission.

7. Service Availability

We strive to keep Nova Vision AI available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Third-party AI provider outages (OpenAI, xAI)
• Unexpected technical failures
• Security incidents

We are not liable for any losses resulting from service interruptions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Nova Vision AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of data or content
• Errors in AI-generated outputs
• Interruption of access to the Service
• Actions taken based on AI-generated information

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $10, whichever is greater.

9. Termination and Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in prohibited activities, or for any other reason at our discretion.

You may delete your account at any time by contacting us. Upon deletion, your account data, saved chats, and generation history will be permanently removed from our systems, subject to any legal retention requirements.

10. Third-Party Services

Nova Vision AI relies on third-party services including OpenAI, xAI, and Google. Your use of features powered by these services is also subject to their respective terms of service. We are not responsible for the practices of these third-party providers.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. If we make significant changes, we will notify registered users by email or a notice on the platform. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
